As the Director of Compliance, you will supervise compliance for all aspects of the software. Your primary duties will consist of ensuring that all legal documents on the system remain in compliance. At the end of 2013, the system maintained approximately 4,300 welfare documents and nearly 95,000 retirement documents. The majority of the pension plan documents are pre-approved, mass submitter documents. As document errors can lead to significant tax and other legal consequences, this position must continuously monitor all legal, regulatory and procedural changes that affect the plan types offered by . In this role you will demonstrate your unique ability to have expertise in several different plan types (defined contribution (DC), defined benefit (DB), 403(b) plans, 409A, 457(b), ESOP, Cash Balance, governmental plans, church plans, and welfare plans). This includes expertise in health care reform.
serves third party administrators (TPAs) and is designed and planned to serve as a total solution for TPAs. The Director of Compliance must be able to see technical and legal changes through the eyes of the customer and provide practical, applied solutions. The Director will also recommend changes to software that improves the workflow of the customers.
Essential Duties &
Responsibilities:
Compliance activities for the product line - supervises Senior Product Support Specialist/Manager, and indirectly supervises all staff Support personnel; ensures the products are providing accurate and up-to-date information
Document drafting - prepares amendments, consent resolutions, SMMs and other updates for changes in law and guidance of all document types on the system (with assistance from other staff attorney(s))
Prepares and oversees the process to have documents and trust language pre-approved with IRS
Coordinates the submission of outside trust agreements from trust companies and large customers
Document consulting - Director position frequently assists customers with document drafting strategy, as well as support on complex 5500 filing questions and compliance software; this position does not provide legal and/or regulatory advice to customers
Ensures support is accurate and superior to competitors - currently support emails are responded to in less than two business hours and calls are handled immediately (serving over 3,000 customers and averaging 1,000 - 2,000 support calls and emails per month)
Product owner - ranks and describes software updates for programming team; reviews and tests software updates to ensure that changes meet legal requirements and are easy and intuitive to use
Ensures that the retirement industry regards staff as leading experts in the industry by regularly publishing industry-related public articles and presenting at industry conferences nationally
Coordinates continuing education accreditation for webcasts and annual User Conference (ERPA program with the IRS, ensures ASPPA and NIPA standards are met)
Evaluates software packages for internal use, including training/webinar (WebEx) and ticketing software (Zendesk) in particular
## Qualifications
Minimum
Qualifications:
JD (Juris Doctorate) degree from an Accredited Institution
5 years of ERISA experience with a leading law or consulting firm
Currently licensed to practice law in the courts of one or more states
A minimum of 2 years of experience working in an environment that utilizes JavaScript, Perl, MySQL, html, the agile development process and Mercurial revision control
Preferred
Qualifications:
Proven ability to understand and articulate ERISA regulatory changes in a team environment
Document drafting (401(a), 403(b), ESOP, Defined Benefit, welfare, and nonqualified plans)
Experience advising pension practitioners with ERISA compliance issues
Knowledge of regulations, legislation, and case law affecting practice area in order to provide practical guidance
Experience with multiple systems of vendor software and data
Broad knowledge of data processing systems, concepts, and methodologies
Experience with XML and/or Programming
Additional Skills, Knowledge & Abilities:
Demonstrated sound judgment, strong legal analysis, and oral and written communication skills
Ability to effectively interact with business owners/managers, compliance personnel, and other attorneys
Ability to provide the appropriate level of guidance and oversight to less experienced attorney(s), paralegal(s), and administrative staff
Ability to perform work independently with minimal supervision and to exercise sound, independent judgment and discretion
Proficiency in MS Office products such as Excel, Word, Outlook and other typical business software applications
Ability to communicate technical concepts to technical and non-technical audiences
Ability to manage multiple concurrent projects and manage professional staff
Strong analytical and problem solving skills
Demonstrated aptitude for learning new technologies
